General Provisions
The purpose of these Terms and Conditions of Sale is to set out the specific terms and conditions governing the sale by Perfumista to its customers (the "Customer") of the products offered for sale via the website www.perfumista.fr owned by Perfumista (the "Site"). The Customer declares that it has been duly informed of these Terms and Conditions before placing an order. An order confirmation constitutes acceptance of these Terms and Conditions of Sale. The GTC apply to the exclusion of any other terms and conditions. Perfumista reserves the right to make changes to these Terms and Conditions at any time. The GTC applicable to the Customer are those in force at the date the order is placed.
Products
Perfumista presents on the Site the products for sale together with their detailed descriptions, in order to comply with article L 111-1 of the French Consumer Code, which provides for the possibility for the potential Customer to know the essential characteristics of the products he wishes to purchase before the final order is taken.
Perfumista may change the composition, characteristics or range of products offered for sale on the Site, as well as their presentation or packaging.
Availability
The products offered for sale by Perfumista are those listed on the Site on the day the Customer visits the Site and are subject to availability.
If a Product is unavailable, Perfumista will inform the Customer as soon as possible by e-mail of the delivery of a partial order or the cancellation of the order. This information may be provided when the order is placed or after the order has been validated before delivery. The customer will then have 48 working hours (excluding weekends and public holidays) to request the cancellation or the delivery under special conditions (partial delivery) of his order, by contacting Customer Service by going to the Contact page. After this 48-hour period, and if no request from the Customer is made to Customer Service, the partial order will be sent for delivery to the Customer. If the Customer's bank account has already been debited at the time of the Customer's notification, Perfumista undertakes to reimburse the Customer as soon as possible for the price of the Product(s) unavailable in the bank account debited at the time of the order. If the Customer requests the cancellation of the entire order, Perfumista undertakes to reimburse the Customer for the sums paid within thirty (30) days at the latest after they have been debited.
Perfumista reserves the right to change or discontinue the products offered on the Site at any time, but such changes will not affect any orders accepted by Perfumista prior to such changes taking effect.
Price and payment
All prices are quoted in Euros. The applicable prices are those indicated on the Site at the time the Customer places an order, unless there is a typographical error.
These prices are inclusive of all taxes in Europe and exclusive of taxes outside Europe, with the exception of costs and duties related to local customs duties on entry into the country of delivery, excluding shipping costs.
The total price indicated on the order summary and the order confirmation email will represent the total amount that will be invoiced including shipping costs.
Shipping costs
For shipments to Metropolitan France, a flat rate of 6€ is applied.
For shipments to Europe, a flat rate of 15€ is applied.
For shipments to the rest of the world, a flat rate of 30€ is applied.
Prices are subject to French VAT for all deliveries in Europe and any change in the legal rate of this VAT will be passed on to the price of the products presented on the Site, on the date stipulated by the application decree referring to it. In the event of use by the Customer of a bank card attached to an account located outside the Euro zone, the Customer may have exchange charges and bank commission applied by his bank, which will remain at the Customer's expense.
Perfumista reserves the right to change its prices at any time and without notice. However, such changes will not affect orders accepted by Perfumista prior to the effective date of such changes, subject to the availability of the products ordered.
In accordance with Article L. 132-2 of the French Monetary and Financial Code, the commitment to pay given by means of a payment card (CB,Visa,Mastercard) is irrevocable. By communicating the information appearing on his debit card, the Customer authorises the Seller to debit his card for the amount corresponding to the global price (product price and shipping costs).
To this end, the Customer confirms that he is the owner of the debit card to be debited and that the name on the debit card is his own. The Customer provides Perfumista with the sixteen digits of his credit card number, the expiry date and the cryptogram if applicable.
Order
Before validating his order, the Customer must check the order summary and the delivery address. Payment is made exclusively online and constitutes final approval of the order.
The contract will be concluded as soon as Perfumista confirms by e-mail that the ordered products have been dispatched and when Perfumista has received the bank transfer or authorisation of the transaction from the issuer of the Customer's payment card.
Perfumista reserves the right to suspend or refuse any order if the authorisation for payment is rejected by financial institutions and/or if an order is placed by a Customer whose previous order with Perfumista has not been paid in full or in part.
Delivery
From the time of delivery, the risk in respect of the products delivered passes to the Customer or to any third party designated by the Customer, other than the carrier proposed by Perfumista. The products are delivered to the delivery address indicated during the ordering process.
The Products purchased will be delivered by the usual postal services or carriers who undertake to deliver the packages within the following average delivery times: Standard: 2 to 15 working days from dispatch. Sundays and public holidays are not considered as working days. In any event, and in accordance with the provisions of article L. 121-20-3 of the French Consumer Code, the order will be executed within a maximum period of thirty (30) days from the day following the day on which the Customer transmitted his order, subject to full payment of the price.
Withdrawal period
In accordance with article 121-21 of the French Consumer Code, the Customer benefits from a withdrawal period of thirty (30) days from the date of receipt of the package containing the products ordered, without having to justify his decision to withdraw.
The withdrawal period will expire after thirty (30) days from the day on which the Customer, or a third party other than the carrier and designated by the Customer, takes physical possession of the products (i.e. the delivery date). To exercise his right of withdrawal, the Customer must inform

The decision to withdraw from the contract by an explicit declaration (e.g. a letter sent by post or e-mail).
In order to comply with the time limits, it is sufficient for the Customer to send this correspondence concerning the exercise of his right of withdrawal before the expiry of the withdrawal period.
If the Customer withdraws from the agreement, Perfumista will refund to the Customer all payments received from the Customer, including delivery charges (except for any additional charges applied if the Customer chooses a method of delivery other than the cheapest standard method offered by Perfumista), without undue delay and regardless of the circumstances, no later than thirty (30) days from the date on which Perfumista has been informed by the Customer of the Customer's wish to withdraw from the agreement.
Perfumista will make the refund using the same means of payment as those used by the Customer for the original transaction; in any event, the Customer will not incur any costs in connection with the refund.
Perfumista will only make a refund upon receipt of all returned products or proof of dispatch of the products, whichever is earlier.

Without undue delay and in any event no later than thirty (30) days after Perfumista has been notified of its decision to withdraw from the Agreement. The time limit is met if the Customer returns the products before the expiry of the thirty (30) day period.
The right of withdrawal does not apply to sealed products that cannot be returned for reasons of health protection or hygiene, if such products have been unsealed after delivery.
Conformity, guarantee and claims management
If the Customer is not satisfied with the purchase, or for any other request related to the commercial and legal guarantees, the Customer may contact Perfumista's customer service department using the contact details provided in the "Contact" section of the Site. Perfumista will report any complaints within seventy-two (72) hours and will endeavour to resolve them as soon as possible.
Notwithstanding any contractual warranty that may be granted, all products offered for sale on the Site are covered by the legal warranty of conformity (articles L211-4 et seq. of the French Consumer Code) and the warranty for defects in the goods sold that render them unfit for their intended use (articles 1641 et seq. of the French Civil Code).
The Customer has a period of two years from the delivery of the product to make a complaint about the legal guarantee of conformity. The Customer may choose between repair or replacement of the defective product, subject to the conditions relating to costs set out in article L.211-9 of the French Consumer Code. The Customer is exempted from the burden of proof concerning the non-conformity of the product for 6 months following delivery of the product (24 months from 18 March 2016).
The Client may submit a claim for hidden defects. He can then choose between cancelling the sale or reducing the price, in accordance with article 1644 of the French Civil Code.
Applicable law and jurisdiction of the courts
These GTC are subject to French law. Subject to the RAL mechanism described above, any dispute, controversy or claim in connection with or arising from these GCS and any order/transaction, including the validity, invalidity or breach of these GCS, shall be resolved by the competent French courts.
Protection of personal data
Perfumista undertakes not to resell the Customer's details to third party companies without its prior agreement. The Customer may receive e-mails from the e-shop with information on the products and activities of the UNIKA e-shop. The Consumer retains the right to refuse such communication afterwards, either by not giving his consent at the time of the validation of the order, or by showing his refusal by contacting the Customer Service by going to the Contact page.
